Guaranteed rent, for terms of up to five years

Prime Host takes a company let of your property on a fixed term and pays a guaranteed rent on the same date every month, whether the property is occupied or not. We furnish, refurbish, equip and maintain it at our own cost, and return it at the end of the term in the condition recorded at the outset.

The proposition

Fixed income, without the landlord obligations

Guaranteed rent is a long-established arrangement in the London market. The distinction from letting through an agent is straightforward: we are not marketing your property to a tenant and taking a commission — we are the tenant, and the rent is our contractual obligation regardless of how the property performs.

Guaranteed monthly rent
A guaranteed monthly rent
The same figure, on the same date, for the whole term. Paid by bank transfer and payable whether the property is occupied, between occupancies or empty. Void periods, arrears and rent reviews cease to be your exposure.

No fees or commission
No fees and no commission
No letting fee, no tenant-find fee, no management commission, no renewal fee and no deduction from the monthly rent. The figure agreed in the lease is the figure that reaches your account.

What it removes

The costs and exposures that erode a rental yield

Gross rent and net return are rarely the same figure. A conventional letting carries a series of deductions and risks that a guaranteed rent agreement transfers to us in full.

  • Void periods between tenancies
  • Rent arrears and recovery costs
  • Management commission and letting fees
  • Tenant-find, referencing and renewal charges
  • Furnishing, white goods and replacement costs
  • Repairs, call-outs and contractor mark-ups
  • Deposit disputes and adjudication
  • Utility and council tax liability between occupancies

How it works

From appraisal to first payment

Step one

Appraisal

We inspect the property, review the title, lease and any restrictions, and assess what is required to bring it to operating standard.

Step two

Written proposal

You receive the guaranteed monthly rent, the proposed term, the works we intend to undertake at our cost, and the consents required before completion.

Step three

Lease and consents

Heads of terms are agreed and the lease is prepared by solicitors. Freeholder and lender consents are obtained, and a schedule of condition is prepared and agreed.

Step four

Handover and payment

We take possession, complete the fit-out at our cost, and rent commences on the date specified in the lease and is paid monthly thereafter.

The agreement

A company let, drawn properly

The property is let to PRIME H UK LTD under a company let for a fixed term. The lease is contracted out of sections 24 to 28 of the Landlord and Tenant Act 1954, so no security of tenure arises and possession returns to you at the end of the term as a matter of right.

A photographic schedule of condition and inventory is prepared and agreed before we take possession, and the property is returned in that condition at the end of the term, subject only to fair wear and tear. We do not sublet the property on a residential tenancy, and no tenancy is created in favour of any occupier.

  • Fixed term, contracted out of the 1954 Act
  • Rent payable monthly by bank transfer on a set date
  • Agreed schedule of condition and inventory
  • Break provisions available on terms, by agreement
  • Prepared and reviewed by solicitors on both sides

Comparison

Guaranteed rent against a managed letting

Guaranteed rent

We are the tenant

A fixed sum every month for the whole term, paid whether or not the property is occupied. No commission, no fees, no repair invoices, no furnishing cost and no correspondence about occupiers. One counterparty, one payment, one point of contact. Income is predictable and can be relied upon for mortgage planning.

Managed letting

An agent acts for you

Rent varies with occupancy and is reduced by commission and fees. Voids, arrears, repairs, appliance replacement, deposit disputes and compliance remain your responsibility and your cost, and the return in any given year depends on how the property has performed.

Maintained London apartment

Division of responsibility

What we carry, and what remains with you

The allocation is set out in the lease rather than left to practice, so there is no ambiguity about who instructs and funds what during the term.

Our responsibility

  • Internal repair, redecoration and upkeep
  • Furniture, appliances and their replacement
  • Utilities, broadband and council tax
  • Cleaning, servicing and consumables
  • Contents insurance for our own furnishings
  • Compliance obligations attaching to the occupation we grant

Retained by you

  • Structure, exterior, roof and common parts
  • Buildings insurance
  • Ground rent and service charge
  • Mortgage and any charge over the property
  • Obligations attaching to your own title or head lease

Before completion

Consents we will require

A guaranteed rent agreement is only sound if it is permitted by the arrangements already affecting your property. We establish that before the lease is signed rather than after, and we will not proceed on the basis that consent can be sought later.

  • Freeholder or superior landlord consent where your title is leasehold and the head lease restricts subletting or company occupation
  • Mortgage lender consent where the property is charged, as most residential and buy-to-let mortgage conditions require it
  • Insurer notification, so that buildings cover is not prejudiced by the manner of occupation
  • Planning position confirmed where the intended use requires it

We will assist with the applications and provide whatever the freeholder, lender or insurer requires from us. You should take independent legal and tax advice on the arrangement before entering into it.

What we take on

Property criteria

We are selective, because the rent we guarantee is underwritten by our own operating performance. Properties that do not meet the criteria are declined rather than taken on at a rent we cannot sustain.

For owners

Guaranteed rent FAQs

The rent

+ Is the rent really paid when the property is empty?
Yes. The rent is our obligation under the lease, not a share of income. It is payable on the contractual date whether the property is occupied, between occupancies or standing empty, and it does not vary with seasonality or demand.
+ How is the rent figure arrived at?
From the property itself: location, size, configuration, condition and the works required to bring it to operating standard, assessed against what the property can sustain over the term. Because we assume the occupancy, cost and maintenance risk, a guaranteed rent is ordinarily set below the gross income a property might achieve in a strong year under a managed letting. What you are acquiring in exchange is certainty and the removal of every deduction listed above.
+ Does the rent increase during the term?
Longer terms may include a fixed uplift at agreed intervals, stated as a figure or a defined percentage in the lease rather than referenced to an index or a review. Whatever is agreed is written into the lease so that you know the rent for every month of the term at the point of signing.
+ Are there any deductions?
None. There is no commission, letting fee, management fee, renewal fee or administration charge, and repairs are not recharged. The rent stated in the lease is the amount transferred to your account.

The agreement

+ What sort of agreement is it?
A company let to PRIME H UK LTD for a fixed term, contracted out of sections 24 to 28 of the Landlord and Tenant Act 1954. No security of tenure arises, so possession returns to you at the end of the term. Occupiers are granted a licence to occupy by us, not a tenancy, and no residential tenancy is created in the property.
+ Can I end the agreement early, or sell?
Break provisions can be included on agreed terms and are negotiated at heads of terms stage. You remain free to sell during the term; the lease binds a purchaser, and in practice a property let on a fixed income to a company can be straightforward to sell to an investor.
+ What condition will the property be returned in?
The condition recorded in the agreed schedule of condition at the outset, subject to fair wear and tear. Any refurbishment or redecoration we undertake during the term is at our cost and is not charged to you, and we do not remove improvements that form part of the fabric.
+ Do I need permission from anyone?
Ordinarily yes. Where your title is leasehold, the head lease may require the freeholder’s consent to subletting or company occupation, and where the property is mortgaged, the lender’s consent is usually required. Your buildings insurer should also be notified. We obtain these before completion, not afterwards.

During the term

+ Who pays for repairs and appliances?
We do, for everything internal: repair, redecoration, servicing and the replacement of furniture and appliances, using our own in-house teams. You retain responsibility for the structure, exterior, roof and common parts, buildings insurance, ground rent and service charge, as set out in the lease.
+ Who pays the utilities and council tax?
We do, in our own name, for the whole term including any period when the property is unoccupied. No supply account or council tax liability remains in yours.
+ Will I be contacted about occupiers?
No. Occupiers contract with us, are supported by our own team 24 hours a day, and have no relationship with you. You are not a point of escalation and you receive no correspondence about the day-to-day running of the property.
+ Are you a letting agent?
No. We are the tenant under the lease, not an agent acting on your behalf. We do not market your property to third parties for a fee, we do not hold rent or deposits belonging to you, and no client money of yours passes through our hands — the rent moves from us to you.
